سياسة الخصوصية Privacy Policy

نحترم خصوصيتك. توضح هذه السياسة البيانات الشخصية التي نجمعها عند استخدامك تطبيق مزاريا وموقعها الإلكتروني (معًا "الخدمة")، والغرض من جمعها وأساسه القانوني، ومع من نشاركها، ومدة الاحتفاظ بها، وحقوقك عليها، وذلك وفقًا لقانون حماية البيانات الشخصية رقم 151 لسنة 2020 ولائحته التنفيذية.

We respect your privacy. This policy explains what personal data we collect when you use the Mazarya app and website (together, the "Service"), why and on what legal basis we collect it, who we share it with, how long we keep it and your rights over it, in accordance with Egypt's Personal Data Protection Law No. 151 of 2020 and its Executive Regulations.

1. من نحن1. Who we are

المسؤول عن معالجة بياناتك هو شركة مزاريا للتسويق الإلكتروني (شركة شخص واحد ذات مسؤولية محدودة)، المقيدة بالسجل التجاري برقم 270733 – مكتب سجل تجاري استثمار القاهرة، ومقرها 57 شارع الدكتور حسن الشريف، مدينة نصر، القاهرة، جمهورية مصر العربية ("مزاريا" أو "نحن"). للتواصل في أي أمر يخص بياناتك: support@mazarya.com.

The controller of your personal data is Mazarya for E-Marketing (a one-person limited liability company), registered in the Commercial Register under No. 270733 at the Cairo Investment Commercial Registry Office, with its registered office at 57 Dr. Hassan El-Sherif Street, Nasr City, Cairo, Arab Republic of Egypt ("Mazarya", "we"). For anything about your data, contact support@mazarya.com.

2. البيانات التي نجمعها ومصادرها2. Data we collect and where it comes from

بيانات تقدمها أنت:

• الحساب: الاسم، واسم المستخدم، والبريد الإلكتروني، ورقم الهاتف، والصورة الشخصية، وتاريخ الميلاد والنوع إن قدّمتهما.
• العناوين: عنوان التوصيل، وعنوان الاستلام للبائعين، بما في ذلك اسم المستلم ورقم هاتفه.
• التحقق من الهوية (للبائعين): الرقم القومي وصورتا وجه وظهر بطاقة الرقم القومي.
• المنتجات: الصور والأوصاف والأسعار التي تنشرها.
• البيانات المالية: مرجع التحويل عند شحن المحفظة، وبيانات الحساب البنكي أو InstaPay التي تقدمها عند السحب. لا نجمع بيانات بطاقات الدفع.
• التواصل: رسائلك إلينا والبلاغات والتقييمات التي تكتبها.

بيانات تنشأ عن استخدامك للخدمة: المزايدات والمشتريات والمبيعات والطلبات وحركات المحفظة والمفضلة ومشاهدات المنتجات، ورمز الإشعارات الخاص بجهازك، وتقارير الأعطال (طراز الجهاز ونظام التشغيل وإصدار التطبيق) مرتبطة بمعرّف حسابك فقط، والسجلات التقنية اللازمة لتشغيل الخدمة وتأمينها.

بيانات من أطراف أخرى: اسمك وبريدك الإلكتروني من Google أو Apple إذا سجّلت الدخول من خلالهما، وحالة الشحنة من شريك التوصيل.

Data you give us:

• Account: your name, username, email, phone number and profile photo, and your date of birth and gender if you provide them.
• Addresses: your delivery address and, for sellers, your pickup address, including the recipient's name and phone number.
• Identity verification (sellers): your national ID number and photos of the front and back of your national ID card.
• Listings: the photos, descriptions and prices you publish.
• Financial data: the transfer reference when you top up your wallet, and the bank account or InstaPay details you give us for withdrawals. We don't collect card details.
• Communications: your messages to us, and the reports and reviews you write.

Data created when you use the Service: bids, purchases, sales, orders, wallet transactions, favourites and listing views; your device's push notification token; crash reports (device model, operating system and app version) linked only to your account ID; and the technical logs needed to run and secure the Service.

Data from others: your name and email from Google or Apple if you sign in with them, and delivery status updates from our delivery partner.

3. أغراض المعالجة وأساسها القانوني3. Why we use it and our legal basis

• تقديم الخدمة (إنشاء الحساب، والنشر، والمزادات، والشراء، والمحفظة، والتوصيل، وخدمة العملاء): لأن ذلك لازم لتنفيذ تعاقدك معنا.
• التحقق من هوية البائعين وتحويل مبالغ السحب: لأن ذلك لازم لتمكينك من البيع ولتحويل أموالك إليك، وللوفاء بالتزاماتنا القانونية في منع الاحتيال وغسل الأموال.
• حماية المستخدمين ومنع الاحتيال وتطبيق الشروط والأحكام، وإثبات الحقوق أو الدفاع عنها: لحماية مستخدمينا وحقوقنا.
• الالتزامات القانونية (السجلات المحاسبية والضريبية، والاستجابة لطلبات الجهات المختصة): تنفيذًا لالتزام قانوني.
• تحسين التطبيق وإصلاح الأعطال: باستخدام أقل قدر ممكن من البيانات.

• Providing the Service (your account, listings, auctions, purchases, the wallet, delivery and customer support): because it is necessary to perform our contract with you.
• Verifying sellers' identity and sending withdrawals: because this is necessary to let you sell and to pay you, and to meet our legal obligations to prevent fraud and money laundering.
• Keeping users safe, preventing fraud, enforcing our Terms, and establishing or defending legal claims: to protect our users and our rights.
• Legal obligations (accounting and tax records, and responding to competent authorities): to comply with the law.
• Improving the app and fixing problems: using as little data as possible.

لا نبيع بياناتك الشخصية، ولا نستخدمها في إعلانات لصالح أطراف أخرى، ولا نستخدمها في أي غرض يتعارض مع الأغراض المذكورة هنا.

We don't sell your personal data, we don't use it for third-party advertising, and we don't use it for any purpose incompatible with those listed here.

4. البيانات الحساسة4. Sensitive data

يعتبر القانون البيانات المالية وبيانات الأطفال بيانات حساسة. لا نطلب بيانات هويتك أو بياناتك المالية إلا عندما تختار البيع أو السحب، ونستخدمها لهذه الأغراض فقط. تُحفظ صور بطاقة الرقم القومي في مساحة تخزين خاصة، ولا يطّلع عليها إلا أنت وفريق مزاريا المخوّل بمراجعة طلبات التحقق.

The law treats financial data and children's data as sensitive. We ask for your identity or financial details only when you choose to sell or withdraw, and we use them only for those purposes. Photos of your national ID card are kept in private storage, and only you and the Mazarya staff authorised to review verification requests can see them.

5. مع من نشارك بياناتك5. Who we share it with

• المستخدمون الآخرون: يظهر ملفك العام (الاسم واسم المستخدم والصورة والمدينة والتقييمات وحالة البائع) ومنتجاتك وتقييماتك للآخرين. لا يظهر رقم هاتفك أو بريدك الإلكتروني أو عناوينك أو بيانات هويتك للمستخدمين الآخرين.
• شريك التوصيل: الاسم ورقم الهاتف وعنوان الاستلام أو التوصيل وتفاصيل الطلب اللازمة لاستلام الشحنة وتوصيلها.
• مزودو الخدمات: جهات تعمل نيابةً عنا وبموجب تعاقدات تُلزمها بحماية بياناتك، في مجالات الاستضافة السحابية وقواعد البيانات، واستضافة الصور، وتقارير الأعطال، وإرسال الإشعارات والبريد الإلكتروني، والترجمة الآلية لنصوص المنتجات عندما يطلبها البائع. لا يحق لهم استخدام بياناتك لأغراضهم الخاصة.
• الجهات المختصة: عندما يلزمنا القانون بذلك أو بناءً على أمر قضائي.
• في حالة نقل ملكية النشاط: إذا انتقلت ملكية مزاريا أو جزء من نشاطها، تنتقل البيانات إلى المالك الجديد ملتزمًا بهذه السياسة.

• Other users: your public profile (name, username, photo, city, ratings and seller status), your listings and your reviews are visible to others. Your phone number, email, addresses and identity details are never shown to other users.
• Our delivery partner: the name, phone number, pickup or delivery address and order details needed to collect and deliver a parcel.
• Service providers: companies acting on our behalf, under contracts that require them to protect your data, for cloud hosting and databases, image hosting, crash reporting, sending notifications and email, and automatic translation of listing text when a seller requests it. They may not use your data for their own purposes.
• Competent authorities: when the law requires it or under a court order.
• A change of ownership: if Mazarya or part of its business changes hands, the data passes to the new owner, who remains bound by this policy.

6. نقل البيانات خارج مصر6. Transfers outside Egypt

تُستضاف قاعدة بياناتنا الرئيسية في الاتحاد الأوروبي (أيرلندا)، وقد يعالج بعض مزودي الخدمات البيانات في دول أخرى. يتم هذا النقل لأنه لازم لتقديم الخدمة التي طلبتها، وبالقدر اللازم لذلك فقط. نلتزم في ذلك بضوابط نقل البيانات المنصوص عليها في القانون ولائحته التنفيذية، ونختار مزودين يوفرون مستوى مناسبًا من الحماية.

Our main database is hosted in the European Union (Ireland), and some service providers may process data in other countries. These transfers take place because they are necessary to provide the Service you asked for, and only to that extent. We follow the conditions the law and its Executive Regulations set for transferring data abroad, and we choose providers that offer an appropriate level of protection.

7. مدة الاحتفاظ7. How long we keep it

• نحتفظ ببيانات حسابك طالما كان حسابك نشطًا.
• عند حذف حسابك تُزال بيانات ملفك الشخصي وعناوينك وصورتك ومنتجاتك المعروضة للبيع، ولن تتمكن من تسجيل الدخول. انظر صفحة حذف الحساب.
• نحتفظ بسجلات الطلبات والمعاملات المالية، دون اسمك، طوال المدد التي تفرضها القوانين المحاسبية والضريبية وقوانين مكافحة غسل الأموال، أو اللازمة لإثبات حق أو الدفاع عنه.
• إذا كنت بائعًا موثّقًا أتممت عمليات بيع، نحتفظ بمستندات التحقق من هويتك للمدة ذاتها لأغراض حفظ السجلات. وفي غير ذلك تُحذف عند حذف الحساب.
• نحتفظ بالسجلات التقنية للمدد التي يفرضها القانون.

• We keep your account data for as long as your account is active.
• When you delete your account, your profile details, addresses, photo and listings for sale are removed, and you can no longer sign in. See our account deletion page.
• We keep records of orders and financial transactions, without your name, for the periods required by accounting, tax and anti-money-laundering laws, or as needed to establish or defend a legal claim.
• If you are a verified seller who has completed sales, we keep your identity verification documents for the same period for record keeping. Otherwise they are deleted when you delete your account.
• We keep technical logs for the periods the law requires.

8. أمان البيانات8. Security

نطبق إجراءات تقنية وتنظيمية مناسبة لحماية بياناتك، منها تشفير البيانات أثناء نقلها، وقصر الوصول على من يحتاجه لأداء عمله. لا يوجد نظام آمن بالكامل؛ وإذا تعرضت بياناتك لخرق يُحتمل أن يمس حقوقك، فسنخطرك ونخطر مركز حماية البيانات الشخصية وفقًا للقانون.

We use appropriate technical and organisational measures to protect your data, including encrypting data in transit and limiting access to people who need it to do their job. No system is completely secure; if a breach affecting your data is likely to put your rights at risk, we will notify you and the Personal Data Protection Center as the law requires.

9. حقوقك وكيفية ممارستها9. Your rights and how to use them

يكفل لك القانون الحقوق التالية:

• العلم بالبيانات الشخصية التي نحتفظ بها عنك والاطلاع عليها والحصول عليها.
• العدول عن موافقتك المسبقة على معالجة بياناتك، دون أن يؤثر ذلك على مشروعية ما تم قبل العدول.
• تصحيح بياناتك أو تعديلها أو محوها أو الإضافة إليها أو تحديثها.
• قصر المعالجة على نطاق محدد.
• العلم بأي خرق أو انتهاك لبياناتك الشخصية.
• الاعتراض على المعالجة أو نتائجها متى تعارضت مع حقوقك وحرياتك الأساسية.

يمكنك تعديل معظم بياناتك من التطبيق مباشرة، وحذف حسابك من الملف الشخصي. ولأي طلب آخر راسلنا على support@mazarya.com من البريد المسجّل في حسابك، وسنرد خلال المدة التي يحددها القانون. وإذا لم تكن راضيًا عن ردّنا، يحق لك تقديم شكوى إلى مركز حماية البيانات الشخصية.

The law gives you the right to:

• know what personal data we hold about you, and access and obtain it;
• withdraw your prior consent to processing, without affecting processing carried out before you withdrew it;
• have your data corrected, amended, erased, supplemented or updated;
• have processing limited to a specific scope;
• be informed of any breach of your personal data;
• object to processing or its results where they conflict with your fundamental rights and freedoms.

You can edit most of your data directly in the app and delete your account from your Profile. For anything else, email support@mazarya.com from the address on your account, and we'll reply within the period set by law. If you're not satisfied with our reply, you have the right to complain to the Personal Data Protection Center.

10. القُصّر10. Minors

الخدمة غير متاحة لمن هم دون 16 عامًا، ولا نجمع بياناتهم عن قصد. إذا كان عمرك بين 16 و18 عامًا فلا يجوز لك استخدام الخدمة إلا بموافقة وليّك أو وصيّك على هذه السياسة. وإذا علمنا أننا جمعنا بيانات طفل دون هذه الموافقة، فسنحذفها.

The Service is not available to anyone under 16, and we don't knowingly collect their data. If you are between 16 and 18, you may use the Service only with the consent of your parent or legal guardian to this policy. If we learn that we have collected a child's data without that consent, we will delete it.

11. الإشعارات والرسائل التسويقية11. Notifications and marketing

نرسل إشعارات تخص حسابك وطلباتك ومعاملاتك لأنها جزء من الخدمة. لن نرسل إليك رسائل تسويقية إلا بموافقتك، ويمكنك إيقافها في أي وقت، وكذلك إيقاف إشعارات التطبيق من إعدادات جهازك.

We send notifications about your account, orders and transactions because they are part of the Service. We send marketing messages only with your consent, and you can stop them at any time. You can also turn off app notifications in your device settings.

12. الموقع الإلكتروني12. Our website

لا يستخدم موقعنا ملفات تعريف ارتباط للتتبع أو الإعلانات، ويحفظ تفضيل اللغة على جهازك فقط.

Our website doesn't use tracking or advertising cookies; it stores your language preference on your device only.

13. تعديل هذه السياسة13. Changes to this policy

قد نحدّث هذه السياسة من وقت لآخر. سننشر النسخة المحدّثة هنا مع تاريخ التحديث، وسنبلغك بأي تغيير جوهري عبر التطبيق أو بريدك الإلكتروني قبل سريانه.

We may update this policy from time to time. We'll post the updated version here with its date, and we'll tell you about any significant change through the app or by email before it takes effect.

14. اللغة14. Language

هذه السياسة متاحة باللغتين العربية والإنجليزية، وفي حالة وجود أي اختلاف بينهما يُعتد بالنص العربي.

This policy is available in Arabic and English. If there is any difference between them, the Arabic text prevails.
