تنظّم هذه الشروط والأحكام ("الشروط") استخدامك لتطبيق مزاريا وموقعها الإلكتروني (معًا "الخدمة")، التي تديرها شركة مزاريا للتسويق الإلكتروني (شركة شخص واحد ذات مسؤولية محدودة)، المقيدة بالسجل التجاري برقم 270733 – مكتب سجل تجاري استثمار القاهرة، ومقرها 57 شارع الدكتور حسن الشريف، مدينة نصر، القاهرة ("مزاريا" أو "نحن"). بإنشاء حساب أو استخدام الخدمة فإنك توافق على هذه الشروط. يُرجى قراءتها بعناية، وإذا لم توافق عليها فلا تستخدم الخدمة.
These Terms of Service ("Terms") govern your use of the Mazarya app and website (together, the "Service"), operated by Mazarya for E-Marketing (a one-person limited liability company), registered in the Commercial Register under No. 270733 at the Cairo Investment Commercial Registry Office, with its registered office at 57 Dr. Hassan El-Sherif Street, Nasr City, Cairo ("Mazarya", "we"). By creating an account or using the Service you agree to these Terms. Please read them carefully; if you don't agree, don't use the Service.
1. دور مزاريا1. Mazarya's role
مزاريا سوق إلكتروني وسيط يتيح للأفراد عرض وبيع وشراء الملابس والإكسسوارات المستعملة عبر مزادات أسبوعية وعروض بسعر ثابت. عقد البيع يُبرم مباشرةً بين البائع والمشتري، ولا تكون مزاريا طرفًا فيه ولا مالكة للمنتجات المعروضة. تقدم مزاريا المنصة، وتحصّل الثمن نيابةً عن البائع وتحتفظ به حتى اكتمال الطلب، وترتب التوصيل من خلال شريك توصيل. لا تفحص مزاريا المنتجات ولا تضمن حالتها أو أصالتها أو مطابقتها لوصفها، والبائع وحده مسؤول عن ذلك.
Mazarya is an intermediary marketplace where individuals list, sell and buy pre-owned clothing and accessories through weekly auctions and fixed-price listings. The contract of sale is made directly between the seller and the buyer; Mazarya is not a party to it and does not own the items listed. Mazarya provides the platform, collects payment on the seller's behalf and holds it until the order completes, and arranges delivery through a delivery partner. Mazarya does not inspect items and does not guarantee their condition, authenticity or match with their description; the seller alone is responsible for those.
2. الأهلية والحساب2. Eligibility and your account
- يجب ألا يقل عمرك عن 16 عامًا. إذا كان عمرك دون 21 عامًا فإنك تقرّ بأن وليّك أو وصيّك قد وافق على هذه الشروط وعلى استخدامك للخدمة، وبأنه مسؤول عن تصرفاتك من خلالها.
- يجب أن تكون بياناتك صحيحة وكاملة ومحدّثة، ولا يجوز لك انتحال شخصية غيرك. لكل شخص حساب واحد فقط.
- أنت مسؤول عن سرية بيانات الدخول وعن كل نشاط يتم من خلال حسابك. أبلغنا فورًا إذا اشتبهت في استخدام حسابك دون إذنك.
- نعالج بياناتك ونخزنها وفق سياسة الخصوصية، بما في ذلك على خوادم خارج مصر، لأن ذلك لازم لتقديم الخدمة لك.
- تُعد السجلات الإلكترونية لدى مزاريا، بما فيها سجلات المزايدات والطلبات والمعاملات والموافقات، دليلًا على ما تتضمنه، وتعتبر موافقتك الإلكترونية على هذه الشروط ملزمة كالتوقيع الكتابي.
- You must be at least 16 years old. If you are under 21, you confirm that your parent or legal guardian has agreed to these Terms and to your use of the Service, and is responsible for your actions on it.
- Your information must be accurate, complete and up to date, and you may not impersonate anyone. Each person may have only one account.
- You are responsible for keeping your sign-in details confidential and for all activity on your account. Tell us immediately if you suspect someone is using it without your permission.
- We process and store your data as described in our Privacy Policy, including on servers outside Egypt, because this is necessary to provide the Service to you.
- Mazarya's electronic records, including records of bids, orders, transactions and acceptances, are evidence of what they contain, and your electronic acceptance of these Terms is as binding as a written signature.
3. التزامات البائع3. Sellers' obligations
بعرضك منتجًا على مزاريا فإنك تقرّ وتضمن ما يلي:
- أنك اجتزت التحقق من الهوية ببطاقة رقم قومي مصرية سارية، وأضفت عنوان استلام داخل نطاق التوصيل.
- أنك المالك الوحيد للمنتج وله حق بيعه، وأنه أصلي وغير مقلّد ولا مسروق ويجوز بيعه قانونًا.
- أن الصور تُظهر المنتج الفعلي، وأن الوصف دقيق ويذكر أي عيوب.
- أن منتجات المزاد تنضم إلى المزاد الأسبوعي التالي، أو إلى مزاد لاحق إذا اكتمل العدد، وأن الحد الأدنى لسعر البداية هو الظاهر في التطبيق.
- أنك ستلتزم بإتمام البيع متى دفع المشتري الثمن، ولا يجوز لك إلغاؤه. إذا تعذّر عليك التسليم، تواصل مع الدعم فورًا.
- أنك ستجهّز المنتج وتسلّمه لمندوب شريك التوصيل عند حضوره، بالحالة الموصوفة.
- أنك مسؤول عن أي التزامات ضريبية تترتب على مبيعاتك.
By listing an item on Mazarya you confirm and guarantee that:
- you have passed identity verification with a valid Egyptian national ID card and added a pickup address within our delivery area;
- you are the sole owner of the item and entitled to sell it, and it is authentic, not counterfeit, not stolen and legal to sell;
- the photos show the actual item, and the description is accurate and mentions any flaws;
- auction items join the next weekly drop, or a later one if it is full, and the minimum starting price is the one shown in the app;
- you will complete the sale once the buyer has paid, and you may not cancel it. If you can't hand over the item, contact support straight away;
- you will have the item ready and hand it to our delivery partner's courier when they arrive, in the condition described;
- you are responsible for any tax obligations arising from your sales.
4. المزادات4. Auctions
- يبدأ المزاد الأسبوعي كل ثلاثاء الساعة 8 مساءً بتوقيت القاهرة، وينتهي كل منتج في الموعد الظاهر عليه.
- أي مزايدة في آخر دقيقتين تمدّ وقت الانتهاء دقيقتين إضافيتين.
- المزايدة إيجاب ملزم بالشراء بالسعر المعروض إذا كانت الأعلى عند الانتهاء، ولا يجوز سحبها.
- للمزايدة يلزم عنوان توصيل داخل نطاق التوصيل، ورصيد في المحفظة يغطي قيمة المزايدة ونصيبك من رسوم التوصيل. يُحجز هذا المبلغ طالما كنت صاحب أعلى مزايدة، ويُفرج عنه فورًا عند تجاوزك.
- إذا فزت ينعقد البيع ويُخصم المبلغ المحجوز تلقائيًا ويُنشأ طلبك.
- يحظر على البائع المزايدة على منتجاته، بنفسه أو من خلال غيره.
- The weekly drop opens every Tuesday at 8 PM Cairo time, and each item closes at the time shown on it.
- A bid in the final two minutes extends the closing time by two minutes.
- A bid is a binding offer to buy at that price if it is the highest when the item closes, and it can't be withdrawn.
- To bid, you need a delivery address within our delivery area and enough wallet balance to cover your bid plus your share of the delivery fee. That amount is held while you are the highest bidder and released immediately if you are outbid.
- If you win, the sale is concluded, the held amount is charged automatically, and your order is created.
- Sellers may not bid on their own items, directly or through anyone else.
5. الشراء المباشر5. Buy Now
منتجات الشراء المباشر لها سعر ثابت، وينعقد البيع عند تأكيدك للطلب. يمكنك الدفع من المحفظة أو نقدًا عند الاستلام حتى الحد الظاهر عند إتمام الشراء. يظهر لك الإجمالي شاملًا رسوم التوصيل قبل التأكيد. رفض استلام طلب بالدفع عند الاستلام دون سبب مقبول يُعد إخلالًا بهذه الشروط.
Buy Now items have a fixed price, and the sale is concluded when you confirm your order. You can pay from your wallet or in cash on delivery up to the limit shown at checkout. You see the total, including the delivery fee, before you confirm. Refusing a cash-on-delivery order without a valid reason is a breach of these Terms.
6. المحفظة والمدفوعات6. Wallet and payments
- المحفظة رصيد داخلي لاستخدامه في الخدمة، وليست حسابًا مصرفيًا أو وديعة، ولا يستحق عنها أي فوائد.
- تشحن محفظتك بتحويل بنكي أو عبر InstaPay إلى حساب مزاريا مع ذكر المرجع الظاهر في التطبيق، ويُضاف الرصيد بعد تأكيدنا لاستلام التحويل. لا نتحمل مسؤولية تحويل تم بمرجع خاطئ أو إلى حساب آخر.
- يمكنك سحب رصيدك المتاح إلى حساب بنكي أو InstaPay باسمك، بحد أدنى 200 جنيه، وتتم معالجة طلبات السحب عادةً خلال 3 إلى 5 أيام عمل.
- يجوز لنا تعليق أو تصحيح أو عكس أي رصيد أُضيف بالخطأ أو يرتبط باحتيال أو بمخالفة لهذه الشروط، وطلب مستندات إضافية قبل تنفيذ السحب.
- The wallet is an internal balance for use on the Service. It is not a bank account or a deposit, and it earns no interest.
- You top up by bank transfer or InstaPay to Mazarya's account, quoting the reference shown in the app; the balance is added once we confirm we received the transfer. We are not responsible for transfers made with a wrong reference or to another account.
- You can withdraw your available balance to a bank or InstaPay account in your own name, with a minimum of EGP 200. Withdrawals are usually processed within 3–5 business days.
- We may hold, correct or reverse any balance added by mistake or linked to fraud or a breach of these Terms, and ask for additional documents before processing a withdrawal.
7. العمولات والرسوم7. Commission and fees
- لا توجد رسوم لنشر المنتجات.
- تحصل مزاريا عمولة من سعر البيع: 12% للبائعين على الباقة الأساسية، و8% للمشتركين في باقة Pro بالسعر الظاهر في التطبيق.
- يتقاسم البائع والمشتري رسوم التوصيل، ويظهر نصيب كل منهما قبل النشر وقبل الشراء.
- يُضاف صافي مستحقات البائع (سعر البيع مخصومًا منه العمولة ونصيب البائع من رسوم التوصيل) إلى محفظته بعد 48 ساعة من التسليم، ما لم يُبلّغ عن مشكلة في الطلب.
- نعلن عن أي تغيير في العمولات أو الرسوم مسبقًا، ولا يسري على المنتجات المعروضة أو الطلبات القائمة وقت التغيير.
- There are no listing fees.
- Mazarya takes a commission on the sale price: 12% for sellers on the Basic plan, and 8% for sellers on the Pro plan, at the price shown in the app.
- The delivery fee is shared between buyer and seller; each side's share is shown before listing and before purchase.
- The seller's proceeds (the sale price minus commission and the seller's share of the delivery fee) are added to their wallet 48 hours after delivery, unless a problem with the order has been reported.
- We announce any change to commission or fees in advance, and it does not apply to items already listed or orders already placed at the time of the change.
8. التوصيل وانتقال المخاطر8. Delivery and risk
نوصّل حاليًا داخل القاهرة والجيزة عبر شريك التوصيل، ويوضح التطبيق ما إذا كانت منطقتك ضمن النطاق. يستلم المندوب المنتج من البائع ويسلّمه للمشتري. تنتقل مخاطر المنتج إلى المشتري عند تسليمه إليه. يلتزم المشتري بتقديم عنوان صحيح وأن يكون متاحًا على هاتفه، وإذا تعذّر التسليم لسبب يرجع إليه يجوز لنا إلغاء الطلب. مواعيد التوصيل تقديرية.
We currently deliver within Cairo and Giza through our delivery partner, and the app shows whether your area is covered. The courier collects the item from the seller and delivers it to the buyer. Risk in the item passes to the buyer on delivery. Buyers must give an accurate address and be reachable by phone; if delivery fails for a reason on the buyer's side, we may cancel the order. Delivery times are estimates.
9. مشكلات الطلبات والاسترداد9. Problems with an order and refunds
- إذا لم يصلك المنتج، أو وصل مختلفًا بشكل جوهري عن وصفه، تواصل مع الدعم خلال 48 ساعة من التسليم مع صور توضح المشكلة.
- سنراجع الطلب ونطلب رد البائع، وقد نوقف تحويل مستحقاته أثناء المراجعة. إذا ثبتت المشكلة نرد لك المبلغ المدفوع إلى محفظتك على مزاريا، وقد يُطلب منك إعادة المنتج.
- بعد انقضاء 48 ساعة من التسليم دون إبلاغ، يكتمل الطلب ويُحوَّل المبلغ للبائع.
- لأن المنتجات مستعملة ويبيعها أفراد، لا يُقبل الإرجاع لمجرد تغيير الرأي، وذلك دون الإخلال بأي حق يكفله لك القانون ولا يجوز الاتفاق على خلافه.
- If your item doesn't arrive, or arrives significantly different from its description, contact support within 48 hours of delivery with photos showing the problem.
- We'll review the order and ask the seller to respond, and we may hold the seller's payout during the review. If the problem is confirmed, we refund the amount you paid to your Mazarya wallet, and you may be asked to return the item.
- If 48 hours pass after delivery without a report, the order completes and the payment is released to the seller.
- Because items are pre-owned and sold by individuals, change-of-mind returns are not accepted. This does not affect any right the law gives you that cannot be waived.
10. المحظورات10. What's not allowed
- عرض منتجات مقلّدة أو تنتهك علامات تجارية أو حقوق ملكية فكرية للغير، أو منتجات مسروقة أو ممنوعة قانونًا، أو منتجات لا تملكها.
- الوصف المضلّل أو إخفاء العيوب أو استخدام صور لا تخص المنتج.
- التلاعب بالمزادات، بما في ذلك المزايدة على منتجاتك أو التواطؤ أو استخدام أكثر من حساب.
- الاتفاق على إتمام البيع أو الدفع خارج مزاريا.
- تقديم مستندات أو بيانات غير صحيحة أو انتحال شخصية الغير.
- إساءة استخدام الخدمة أو محاولة اختراقها أو تعطيلها أو جمع بيانات المستخدمين منها.
- الإساءة إلى المستخدمين الآخرين أو إلى فريق مزاريا، أو نشر محتوى مخالف للقانون أو الآداب العامة.
- Listing counterfeit items or items that infringe others' trademarks or intellectual property, stolen or illegal items, or items you don't own.
- Misleading descriptions, hiding flaws, or using photos that aren't of the item.
- Manipulating auctions, including bidding on your own items, colluding, or using more than one account.
- Arranging to complete a sale or payment outside Mazarya.
- Submitting false documents or information, or impersonating anyone.
- Misusing, hacking, disrupting or scraping the Service.
- Abusing other users or the Mazarya team, or posting content that breaks the law or public morals.
11. المحتوى والملكية الفكرية11. Content and intellectual property
تظل ملكية صورك وأوصافك وتقييماتك لك، وتمنح مزاريا ترخيصًا غير حصري ومجانيًا وقابلًا للترخيص من الباطن لعرضها ونسخها وترجمتها وتعديل حجمها واستخدامها لتشغيل الخدمة والترويج لها طوال مدة وجودها على المنصة. وتقرّ بأن لك الحق في منح هذا الترخيص. اسم مزاريا وشعارها وتصميم الخدمة ومحتواها مملوكة لمزاريا، ولا يجوز استخدامها دون إذن كتابي.
You keep ownership of your photos, descriptions and reviews, and you give Mazarya a non-exclusive, royalty-free, sublicensable licence to display, copy, translate, resize and use them to operate and promote the Service while they are on the platform. You confirm you have the right to give this licence. The Mazarya name and logo and the Service's design and content belong to Mazarya and may not be used without written permission.
12. التقييد والإيقاف وإغلاق الحساب12. Restriction, suspension and closing your account
يجوز لنا إزالة أي محتوى أو منتج، أو تقييد أي حساب أو إيقافه أو إنهاؤه، إذا خالف هذه الشروط أو القانون أو عرّض المستخدمين أو مزاريا للخطر، ونبلغك بالسبب ما لم يمنعنا القانون من ذلك. يظل أي رصيد مستحق لك قابلًا للسحب بعد تسوية أي التزامات قائمة. يمكنك حذف حسابك في أي وقت من التطبيق بعد سحب رصيدك وإتمام طلباتك الجارية؛ راجع صفحة حذف الحساب.
We may remove any content or listing, or restrict, suspend or terminate any account, if it breaks these Terms or the law or puts users or Mazarya at risk, and we'll tell you why unless the law prevents us. Any balance owed to you remains withdrawable once any outstanding obligations are settled. You can delete your account at any time in the app once your balance is withdrawn and your open orders are complete; see our account deletion page.
13. حدود المسؤولية13. Limitation of liability
- تُقدَّم الخدمة "كما هي" و"حسب توفرها"، ولا نضمن أن تعمل دون انقطاع أو أخطاء.
- لا نتحمل المسؤولية عن تصرفات المستخدمين أو المنتجات التي يعرضونها أو تعهداتهم، ولا عن الأضرار غير المباشرة أو التبعية أو الربح الفائت.
- في جميع الأحوال تقتصر مسؤوليتنا تجاهك فيما يخص أي طلب على المبلغ الذي دفعته فيه.
- لا يحد أي مما سبق من مسؤوليتنا عن الغش أو الخطأ الجسيم، أو من أي حق لك لا يجوز الحد منه قانونًا.
- The Service is provided "as is" and "as available", and we don't guarantee it will be uninterrupted or error-free.
- We are not responsible for other users' actions, the items they list or their promises, or for indirect or consequential losses or lost profits.
- In all cases, our liability to you for any order is limited to the amount you paid for it.
- Nothing here limits our liability for fraud or gross negligence, or any right you have that cannot be limited by law.
14. التعويض14. Indemnity
تلتزم بتعويض مزاريا عن أي مطالبات أو خسائر أو مصروفات، بما فيها أتعاب المحاماة المعقولة، تنشأ عن مخالفتك لهذه الشروط أو للقانون، أو عن منتج عرضته، أو عن انتهاكك لحقوق الغير.
You agree to compensate Mazarya for any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or the law, from an item you listed, or from your infringement of anyone else's rights.
15. أحكام عامة15. General terms
- تعديل الشروط: قد نحدّث هذه الشروط، وسنبلغك بأي تغيير جوهري عبر التطبيق أو بريدك الإلكتروني قبل سريانه بمدة معقولة. استمرارك في الاستخدام بعد السريان يعني قبولك للشروط المحدّثة.
- القوة القاهرة: لا نُسأل عن أي تأخير أو إخفاق يرجع إلى ظروف خارجة عن إرادتنا المعقولة.
- الإخطارات: نرسل الإخطارات إليك عبر التطبيق أو بريدك الإلكتروني المسجّل، وتُرسل إخطاراتك إلينا على support@mazarya.com.
- استقلال البنود: إذا اعتُبر أي بند باطلًا أو غير قابل للتنفيذ، تظل باقي البنود سارية.
- عدم التنازل: عدم ممارستنا لأي حق لا يُعد تنازلًا عنه.
- الحوالة: لا يجوز لك نقل حقوقك أو التزاماتك بموجب هذه الشروط إلى غيرك. ويجوز لنا ذلك في حالة نقل ملكية النشاط.
- الاتفاق الكامل: تمثل هذه الشروط وسياسة الخصوصية الاتفاق الكامل بينك وبين مزاريا بشأن الخدمة.
- اللغة: هذه الشروط متاحة باللغتين العربية والإنجليزية، وفي حالة وجود أي اختلاف بينهما يُعتد بالنص العربي.
- Changes: we may update these Terms, and we'll tell you about any significant change through the app or by email a reasonable time before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
- Force majeure: we are not responsible for any delay or failure caused by circumstances beyond our reasonable control.
- Notices: we send notices to you through the app or your registered email; send notices to us at support@mazarya.com.
- Severability: if any provision is found invalid or unenforceable, the rest remain in effect.
- No waiver: our not exercising a right does not waive it.
- Assignment: you may not transfer your rights or obligations under these Terms. We may do so if the business changes hands.
- Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and Mazarya about the Service.
- Language: these Terms are available in Arabic and English. If there is any difference between them, the Arabic text prevails.
16. القانون الواجب التطبيق والاختصاص16. Governing law and jurisdiction
تخضع هذه الشروط لقوانين جمهورية مصر العربية. نسعى أولًا إلى حل أي خلاف وديًا من خلال التواصل مع الدعم، فإن تعذّر ذلك خلال 30 يومًا تختص محاكم القاهرة المختصة بنظره.
These Terms are governed by the laws of the Arab Republic of Egypt. We will first try to resolve any dispute amicably through support; if that isn't possible within 30 days, the competent courts of Cairo have jurisdiction.
